SportsSpread Terms and Conditions

Effective date 01 January 2025

These Terms govern every SportsSpread.com account and all betting and related services provided through the website, by telephone or by any other permitted channel. Each numbered clause is a separate contractual term.

1 Operator and agreement

1.1 SportsSpread.com is operated by Tradespreads Ventures SRL, Costa Rica (SportsSpread, we, us or our).

1.2 The agreement is between Tradespreads Ventures SRL and the individual registered as the account holder (you or the client).

2 Acceptance of the Terms

2.1 You accept these Terms when you register, deposit funds, place a bet or otherwise access or use an account or the services.

2.2 You are responsible for reading these Terms and the rules applying to each market before betting.

3 Age and capacity

3.1 You must be at least 23 years old, or older if the age of majority or lawful gambling age in your location is higher.

3.2 You must have legal capacity to enter a binding agreement with us.

4 Legality of use

4.1 We do not represent that the services are lawful in every location.

4.2 You are responsible for complying with the law that applies to you and must not use the services where doing so is unlawful.

5 One account per client

5.1 An account is personal to the registered account holder.

5.2 Unless we approve otherwise in writing, each person may open, control and benefit from only one account.

5.3 A duplicate, linked or substitute account includes an account opened, funded, controlled or used for the benefit of the same person, including through a spouse, relative, associate, nominee, business or other third party.

6 Personal operation of the account

6.1 Only the registered account holder may access, fund, operate or control the account.

6.2 The registered account holder must personally decide, instruct and place every bet.

6.3 You must not allow another person to use the account, password, device session or betting facilities, or to direct, control, select or transmit bets through the account, including through remote-access or screen-sharing software.

6.4 You must not operate an account for another person or act as an agent, nominee or intermediary.

7 Account security

7.1 You must keep login and security details confidential and tell us immediately about suspected unauthorised access.

7.2 Use of the correct login details does not establish that a bet was authorised or personally placed by the registered account holder.

8 Ownership and source of deposited funds

8.1 All deposits must come from a bank account, card or payment method held in your own name and controlled by you.

8.2 You must be the genuine beneficial owner of the account and of all funds used in it.

8.3 Money supplied by a spouse, relative, employer, business partner or any other third party, including by gift, loan, reimbursement or transfer, must not be used unless we approved it in writing before the deposit.

8.4 You must not fund another customer's account or receive funds for the purpose of funding or operating an account.

9 Accuracy of information

9.1 All information and documents supplied to us must be complete, accurate and not misleading.

9.2 You must promptly notify us if any registration, contact, financial, payment or verification information changes.

10 Verification checks

10.1 We may carry out identity, age, address, payment-method, fraud, security, source-of-funds and source-of-wealth checks at any time, including before or after deposits, bets, withdrawals or account closure.

10.2 We may repeat checks whenever we consider it reasonably necessary and may use appropriate third-party verification and fraud-prevention services.

11 Source of funds and source of wealth evidence

11.1 You must promptly provide any information and documents we request and explain the direct and ultimate source of funds used.

11.2 We may request identification, proof of address, bank and card statements, payment records, payslips, tax returns, business or company records, evidence of an asset sale, inheritance, gift or loan documentation, source-of-wealth evidence, bank references, certified or notarised documents, or confirmation from a relevant third party.

11.3 Documents must be genuine, complete, legible and unaltered and must show the movement and origin of funds sufficiently for us to verify ownership, affordability and legitimacy.

11.4 Evidence showing only that money entered a payment account, without explaining its underlying source, may be insufficient.

12 Restrictions during checks

12.1 While checks are pending, or where information is incomplete, inconsistent or unsatisfactory, we may suspend the account, refuse deposits or bets, withhold or delay withdrawals, close open positions and restrict access to any part of the services.

12.2 We may close the account if checks are not completed to our reasonable satisfaction.

13 Acceptance and refusal of bets

13.1 We may refuse all or part of any bet and may limit the stake accepted on any bet without giving a reason where permitted by law.

13.2 A bet is not accepted until it is confirmed as accepted on our system.

14 Aggregate exposure

14.1 We may limit the aggregate size of outstanding bets or open exposure held by any client in any market at any time.

15 Stop loss and stop win

15.1 We may set or amend a stop-loss or stop-win for a market.

15.2 A stop-loss limits losses only where one is expressly stated for the relevant market.

16 No betting advice

16.1 We do not advise whether a bet should be placed. We facilitate bets and may provide factual information where available.

17 Client responsibility for bets

17.1 You must check that each bet has been accepted correctly and that the positions shown on the account are accurate.

17.2 You are responsible for monitoring open positions, price movements and margin requirements.

18 Market rules

18.1 You must understand the rules, trading conditions and stop-loss or stop-win applying to a market before betting.

18.2 Where a quoted market is not described on the website, you must obtain its applicable rules before placing a bet.

19 Errors

19.1 We may correct or void a bet affected by an obvious pricing, market, settlement, data or technical error, including after settlement.

19.2 No client may knowingly exploit or retain the benefit of an error.

20 Open positions

20.1 We may suspend a market, close an open position or void an open bet where reasonably necessary to address suspected fraud, cheating, unauthorised account use, an error, a risk-control issue or circumstances beyond our reasonable control.

20.2 We will normally try to contact the client before closing a position where reasonably practicable.

21 Leveraged losses

21.1 Spread betting is leveraged and you may lose more than your deposit or credit balance.

21.2 Cash deposited with us does not limit potential losses in a market without an express stop-loss.

22 Margin

22.1 We may require additional funds at short notice to maintain an open bet.

22.2 If required margin is not provided when requested, we may close the position and you remain liable for any resulting debit balance.

23 Debit balances and set off

23.1 Where permitted, we may recover an amount due using a payment method previously registered by you.

23.2 We may set off an amount owed to us against money otherwise payable to you or held in a duplicate or linked account.

24 Withdrawal verification

24.1 Your account must be fully verified before we process any withdrawal.

24.2 You must complete all verification requirements, which may include photographic identification, proof of address dated within the previous three months, proof of payment method and source-of-funds or source-of-wealth evidence.

24.3 Your account must satisfy our AML and KYC policies and procedures, together with any relevant requirements under laws or regulations applicable to the account, the customer, a transaction or a payment provider.

25 Withdrawal limits and conditions

25.1 All accounts are subject to maximum cumulative daily, weekly and monthly withdrawal limits.

25.2 We may set or vary those limits according to account status, verification, risk, payment arrangements and operational requirements.

25.3 A withdrawal remains subject to completion of checks, settlement of open bets and debit balances, these Terms, payment-provider requirements and any investigation concerning the account or a related account.

26 Promotion conditions

26.1 A promotion is subject to its specific published conditions.

26.2 Unless stated otherwise, winnings from a new-account promotion cannot be withdrawn for 90 days and winnings derived from bonuses, goodwill credits or promotions cannot be withdrawn for at least 30 days.

26.3 A client who receives a cash or bonus promotion without depositing personal funds cannot withdraw it or related winnings for 90 days and must keep the account active during that period.

26.4 Unless stated otherwise, the maximum withdrawal of winnings derived from bonuses is twice the bonus amount in a 30-day period.

26.5 Unless stated otherwise, deposited funds and winnings from a free bet must be turned over twice before withdrawal. Turnover is stake multiplied by half the spread width on each bet.

27 Promotion review and reversal

27.1 We may withdraw an offer, remove a bonus, reverse promotional winnings or void affected transactions where we reasonably believe a promotion has been manipulated, used contrary to its purpose or exploited through collusion, linked accounts, risk-free betting, opposing bets, deposit and withdrawal cycling or referrals for the customer's own use.

28 Inactive accounts

28.1 An account with no login, deposit, withdrawal, bet or settlement for 12 consecutive months may be treated as inactive.

28.2 We may charge an administration fee of EUR 5 per month from the start of inactivity until the earliest of 30 months, account closure or renewed account activity.

28.3 An account reactivated after at least 12 months may be treated as a new account for withdrawal and promotional conditions.

29 Client communications and conduct

29.1 Threatening, abusive, discriminatory, obscene or seriously offensive communications to our staff are not permitted.

29.2 We may restrict communications, suspend services or close an account where reasonably necessary to protect staff or the service.

30 Third party providers

30.1 We may use and replace third-party providers to support payments, verification, technology, communications, gaming content or other parts of the services.

30.2 A third-party service may be subject to clearly notified additional terms.

31 Assignment

31.1 By accepting these Terms, you give your advance consent to us assigning, transferring, novating, selling or otherwise disposing of all or any part of our rights, obligations, business or customer contracts to another company or person.

31.2 A transfer may be made to an affiliated company, a purchaser or successor to the business, or another operator established in Costa Rica or any other jurisdiction, including as part of a sale, group reorganisation, change of ownership, change of headquarters, licensing arrangement or transfer of the SportsSpread business.

31.3 The recipient of a transfer may assume our rights and obligations under your customer contract and will then be treated as SportsSpread, we, us or our under these Terms. Your account, balance, open positions and existing contractual obligations will continue with that recipient, subject to these Terms.

31.4 No further consent, signature, approval or novation agreement is required from you. Except where applicable law requires otherwise, we are not required to give you individual or direct notice before a transfer takes effect. We may record the transfer by updating the operator details or these Terms on the website.

31.5 You may not transfer your account or your rights or obligations under these Terms without our prior written consent.

32 Collusion cheating fraud and criminal activity

32.1 The following are Prohibited Practices and are not permitted:

(a) abuse of bonuses, promotions, goodwill credits, refunds or incentives;

(b) using unfair external factors or influences, commonly known as cheating;

(c) taking or attempting to take an unfair advantage;

(d) opening, operating, funding, controlling or benefiting from a Duplicate Account or linked account;

(e) third-party funding or third-party operation of an account contrary to clauses 6 or 8;

(f) collusion or coordinated betting with another person or account;

(g) a fraudulent practice, payment abuse, chargeback abuse or criminal activity; and

(h) assisting, attempting, facilitating or being connected with any of the above.

32.2 You must not participate in, assist or be connected with a Prohibited Practice in connection with the services, whether the conduct is carried out by you, on your behalf, for your benefit or in collusion with another person.

32.3 We may act under this clause if:

(a) we have reasonable grounds to believe that you participated in, assisted or were connected with a Prohibited Practice. Our grounds may include fraud, cheating and collusion detection methods used in the gambling and gaming industry, account and device information, payment information, betting patterns, market timing, data-feed comparisons or other reasonably available evidence;

(b) we become aware that you have been suspected, restricted, suspended or investigated by another gambling service, payment provider, sports body or authority for a Prohibited Practice or otherwise improper activity, where that information reasonably relates to risk on your account;

(c) you make, threaten or attempt a chargeback, payment denial or reversal concerning a genuine deposit, loss or transaction; or

(d) you fail to provide satisfactory information or evidence concerning identity, account control, linked accounts, payment ownership, source of funds or source of wealth.

32.4 Where clause 32.3 applies, we may suspend or close the account and any related account; refuse or delay withdrawals; close positions; grade pending bets as No Action; refuse, cancel or void affected bets, including retrospectively; reverse affected winnings, bonuses, credits or pay-outs; combine information and balances across linked accounts; set off amounts owed to us; and withhold or recover deposits, pay-outs, bonuses or winnings affected by or attributable to the relevant conduct.

32.5 A fraudulent practice includes, without limitation:

(a) a fraudulent chargeback, payment reversal, rake-back activity or false denial of a deposit or purchase;

(b) using a stolen, cloned, unauthorised or third-party card, bank account or payment method;

(c) colluding with another person to obtain an unfair advantage, including through a bonus, promotion or incentive;

(d) providing false, misleading, incomplete, forged or altered registration, verification, payment or source-of-funds information;

(e) concealing the true account operator, beneficial owner, source of funds, source of wealth or relationship between accounts; and

(f) any actual or attempted act which we reasonably consider illegal, dishonest, in bad faith, intended to defraud us or intended to circumvent a contractual, payment, security, location, account or legal restriction, whether or not it causes loss.

32.6 An unfair advantage includes, without limitation:

(a) exploiting delayed information or placing or attempting to place an in-play bet after the relevant event has occurred, or when you possess materially more current event information than the service;

(b) exploiting a fault, loophole, latency, price, settlement, data, software, system or third-party error;

(c) using a bot, script, automated player, remote-access tool, unauthorised software, data feed or analysis system;

(d) circumventing a stake, exposure, location, account, identity, verification, payment or withdrawal restriction; and

(e) coordinating accounts, funding, devices or bets to disguise common control, beneficial ownership or betting activity.

32.7 Bonus abuse includes, without limitation:

(a) depositing to receive a bonus without genuine betting activity using the deposited funds;

(b) withdrawing or cashing out for the purpose of re-depositing to obtain another bonus;

(c) betting both sides of an event, or coordinating bets, to create artificial turnover or satisfy a rollover requirement without genuine risk; and

(d) referring, opening or using a new account for your own or another existing customer's benefit.

32.8 We may use names, addresses, contact details, devices, IP addresses, location information, payment methods, funding sources, account-access patterns, betting selections, timing and other behaviour to identify Duplicate Accounts, linked accounts, common control or common beneficial ownership. We may investigate and deal with those accounts together.

32.9 Where a breach involves deception, unauthorised operation, concealed third-party funding, linked accounts, cheating or fraud, we may treat all activity connected with the breach as affected. Any remaining balance will be dealt with after verification, subject to our rights of deduction, recovery and set-off and any legal or regulatory requirement to retain or disclose funds.

32.10 We may disclose relevant information to payment providers, sports governing bodies, service providers, regulators, law-enforcement bodies or other appropriate authorities.

33 Suspension and closure

33.1 You may request account closure after all open positions, debit balances, verification requirements and pending reviews have been resolved. A withdrawal following account closure is subject to a EUR 100 processing fee.

33.2 We may suspend or close an account by written notice, or attempted notice using the registered contact details.

33.3 We may act immediately where reasonably necessary for security, risk management, verification, suspected breach, legal or operational reasons.

33.4 Suspension prevents deposits, withdrawals, betting and other activity and stops bonuses or contingent winnings being credited until we reactivate or close the account.

33.5 If we close an account without a suspected breach, we will return the available balance after settling open positions, debit balances, applicable fees and required checks. If closure follows a suspected or established breach, clause 32 applies.

34 Restricted locations

34.1 We do not accept business from a person resident, located or domiciled in a restricted country or territory.

34.2 You must not provide a false address, conceal your location or use technology to circumvent a location restriction.

34.3 We may suspend or close an account and apply clause 32 where location information has been concealed or falsified.

35 Changes to these Terms

35.1 We may amend these Terms for a valid reason, including changes to law, regulation, regulatory guidance, taxation, technology, payment arrangements, security, fraud prevention, market rules, products, service providers, customer protection or operation of the service.

35.2 Revised Terms may be published on the website with their effective date. Publication on the website is sufficient notice of an amendment and, except where applicable law requires otherwise, we are not required to give separate, individual or direct notice by email, telephone, account message or any other means.

35.3 An amendment may take effect on publication or on a later date stated in the revised Terms. A change required for legal, regulatory, security, fraud-prevention, commercial, operational or technical-integrity reasons may take effect immediately.

35.4 By accepting these Terms, you agree in advance that we may amend them in accordance with this clause. No further consent, signature or express acceptance is required from you unless applicable law requires it.

35.5 Subject to applicable law, an amendment is binding on all accounts from its effective date whether or not a client has reviewed it. Continued access, deposit, betting or use on or after that date confirms acceptance of the revised Terms.

35.6 You are responsible for reviewing the Terms published on the website from time to time. If you do not accept an amendment, you must stop using the services and may request closure, subject to open positions, debit balances, verification requirements and pending reviews.

35.7 An amendment will not change a bet finally settled before its effective date, except where these Terms permit correction or voiding of an error, fraud, cheating, unauthorised account use or another breach discovered later.

36 Events beyond our control

36.1 We are not responsible for failure or delay caused by events beyond our reasonable control, including failure of communications, data feeds, systems, payment networks or third-party services.

36.2 Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

37 Governing law and jurisdiction

37.1 These Terms and any dispute arising from them are governed by the laws of Costa Rica.

37.2 Subject to rights that cannot lawfully be excluded, the courts of Costa Rica have exclusive jurisdiction.

37.3 We may also bring a claim against a client in the courts of the client's country of residence or domicile.

38 Severability and no waiver

38.1 If any provision is held invalid or unenforceable, the remaining provisions continue in effect to the fullest extent permitted by law.

38.2 A delay or failure by us to enforce a provision does not waive our right to enforce it later.
